This website and store are operated by Boutique Home Centre. Throughout the site, the terms “we”, “us” and “our” refer to Boutique Home Centre. Boutique Home Centre offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site. Please read these Terms of Service carefully before accessing or using our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory of residence. You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction. You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.

Products and Pricing

• Pricing. All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice.
• Natural variation. Tiles, stone and timber are natural or manufactured products and may vary in shade, size, texture and finish between batches. We recommend ordering all the stock you need in a single order and allowing for cutting and wastage.
• Availability. Certain products may be available exclusively online and in limited quantities. We have made every effort to display product colours and images as accurately as possible but cannot guarantee that your screen will display them accurately.
• Order acceptance. We reserve the right to limit the quantities of, or to refuse, any order, and to correct any pricing or description errors and cancel the affected orders (refunding any amount paid).

Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Returns

We accept returns on eligible items within 7 days of delivery, provided they are unused, in their original condition, and accompanied by proof of purchase. A 20% restocking fee applies to accepted returns. Certain items, such as custom orders, cut-to-size products and clearance items, may not be eligible for return. Nothing in this section limits your rights under the Australian Consumer Law.

Payment, Delivery and Pickup

Orders must be paid in full before dispatch or collection unless otherwise agreed in writing. Delivery and Click & Collect are subject to our Delivery and Click & Collect conditions, including freight that is arranged separately and our 200 kg vehicle safe-payload limit for collection.

Certain content, products and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice (including after you have submitted your order).

Prohibited Uses

You are prohibited from using the site or its content for any unlawful purpose, to solicit others to perform or participate in any unlawful acts, to infringe upon or violate our intellectual property rights or those of others, to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate, to submit false or misleading information, or to upload or transmit viruses or any other type of malicious code. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded. To the extent permitted by law, our liability for a failure to comply with a consumer guarantee is limited to the replacement or repair of the goods, the supply of equivalent goods, or the cost of doing so. Except as expressly stated, the Service and all products delivered to you are provided “as is” and “as available” for your use, without any representation, warranties or conditions of any kind to the extent permitted by law.

Indemnification
